Terms & Conditions

These Terms & Conditions are an agreement between you and Onyx Works (“Onyx Works,” “we,” “us”). They apply when you use onyxworks.io, submit a form, use one of our free tools, book a call, chat with us, or receive email or text messages from us.

If you don't agree with them, don't use the site or opt in to our messages. If you are agreeing on behalf of a business, you confirm you are allowed to.

Onyx Works builds and operates growth systems for businesses — websites, lead capture and follow-up, outbound prospecting, customer reactivation, AI chat and voice assistants, and the dashboards behind them. What we sell is described on this site; what we actually owe a client is described in a signed agreement.

If you are a client, your written agreement controls. Our Master Services Agreement, any Scope of Work under it, and any performance guarantee stated in it govern the work, the fees, the deliverables, and the remedies. Where those documents and this page disagree, those documents win. This page governs your use of the public site and our messaging, nothing more.

We publish free tools — the Lead Leak Audit, sample builds, and personalised demos among them. They are provided as-is, for information only.

Anything they estimate — recoverable revenue, leak scores, projected results — is an illustration based on the answers you give and general assumptions. It is not a forecast, an appraisal, or professional advice, and no result is promised. Demos may contain sample data and fictional businesses; where they do, we label it.

These are the full terms of the Onyx Works text messaging program.

Program description. Onyx Works sends two kinds of text message, and you consent to them separately:

• Marketing messages — new offers, availability, and occasional tips on getting more from the customers you already have.
• Non-marketing messages — appointment reminders, booking confirmations, replies to something you asked us, and account or project notifications.

How to opt in. You opt in by checking the relevant box on our opt-in form, by agreeing in writing, or by texting us first. Both checkboxes are optional and unchecked by default. Consent to receive text messages is not a condition of purchasing any goods or services from us. You must be the subscriber of the mobile number you give us, or be authorised by that person, and you must be at least 18.

Message frequency. Message frequency varies, and is typically fewer than 4 messages per month.

Cost. Onyx Works does not charge for these messages. Message and data rates may apply under your plan with your mobile carrier.

Opting out of one thing, not everything. Replying STOP to a marketing message stops marketing texts. Tell us in any channel and we will honour a broader request — including stopping every kind of message from us — and you never have to use a particular word or a particular channel to revoke consent.

Carriers and delivery. Message delivery depends on your mobile carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages. The program is supported on major U.S. carriers, but carrier support can change without notice. If you change or give up your mobile number, tell us, so we don't message the next person who has it.

Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text-message opt-in data and consent are never shared with any third party. See the Privacy Policy for the full clause.

We send email to people who ask us to, to people we are already talking to, and to businesses as part of professional outreach. Every marketing email carries our postal address and a working unsubscribe link, and we action unsubscribes promptly. Replying and asking works just as well as the link.

When you book a call you agree we may contact you about that booking. Calls to or from numbers we operate may be answered by an automated assistant and may be recorded or transcribed. Maryland law requires everyone on the call to consent to recording, so we will tell you at the start of the call when recording is in use, and you can decline or ask for a human.

You agree not to:

• Submit someone else's phone number, email address, or details without their permission.
• Submit false information or impersonate anyone.
• Attempt to break, overload, scrape, probe, or gain unauthorised access to the site, our dashboards, or our systems.
• Use our tools or content to build a competing service.
• Use the site for anything unlawful.

We can suspend access, remove content, or stop messaging anyone who does.

The site, its copy, design, code, and the Onyx Worksname and marks belong to us. You may read, share, and quote reasonable extracts with attribution. You may not copy the site wholesale, resell our materials, or present our work as yours. Work produced for a client is owned as that client's agreement says — not as this page says.

The site links to and embeds third-party tools — a booking calendar, a chat widget, client and demo sites. We don't control them and aren't responsible for their content or their practices. Their terms and privacy policies apply when you use them.

The site and the free tools are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the site will be uninterrupted or error-free, or that any information on it is complete or current. Nothing on the site is legal, tax, or financial advice. This section does not limit any warranty we give a client in a signed agreement.

To the fullest extent the law allows, Onyx Worksis not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the site, the free tools, or our messaging — even if we were told such damages were possible. Our total liability for claims relating to the site, the free tools, or our messaging is limited to one hundred U.S. dollars ($100). Liability arising from client work is governed by that client's agreement instead. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

You agree to indemnify and hold harmless Onyx Works from claims, damages, and reasonable costs arising from your breach of these terms or your misuse of the site — including any claim arising because you gave us a phone number or email address you were not authorised to give us.

These terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. Any dispute relating to them will be brought in the state or federal courts located in Charles County, Maryland, and you consent to that venue. Before filing anything, email us — most things are a five-minute conversation.

We may update these terms. The date at the top of the page shows when they last changed, and continuing to use the site or stay opted in to messages after a change means you accept the updated terms. If we change the messaging program materially, we will say so in a message rather than quietly editing this page.
